10. Offences against property
 
  Article 77-Offences of obtaining property by robbery  
77.1 Robbery  
  Robbery is the open stealing of other people's property.  
 
 Primary Fact(s)
 1. That property has been taken from the victim's possession.
 2. That the property was taken by force and/or threat or intimidation from the victim's possession;
 3. That the property was taken with the knowledge of the victim at the time of the offence;
 4. That the actions of the accused contributed to the taking of the property;
 
 
 Penalty Conditions (Level 3-Crime)
Type
Condition(s)
1-3
a) by an individual without violence or possession of weapon;
b) with an illegal entry into a storehouse
4-6
a) with the use of coercion that is not dangerous to human life or health;
b) with the threat of use of coercion;
c) by a group of persons in a preliminary conspiracy;
 
 
 Penalty Conditions (Level 4-Crime)
Type
Condition(s)
1-3
a) by an individual without violence in possession of weapon;
b) by a member of an organized group without violence;
c) for the purpose of obtaining property on a large scale;
d) with an illegal entry into a non-bank premises;
4-6
a) with the use of weapons or objects used as a weapons;
b) with an illegal entry into a bank premises without violence;
c) with an illegal intrusion in a home without violence;
d) involving the taking of hostages, released unharmed;
 
 
 Penalty Conditions (Level 5-Crime)
Type
Condition(s)
1-3
a) repeated robbery whether actual or attempted;
b) with an illegal intrusion in a home with violence;
4-6
a) with an illegal entry into any premises with violence
b) with the infliction of serious injury to one or more victim(s);
c) by a person who earlier two or more times was convicted of larceny or extortion;
d) involving the taking of hostages, released with serious injury;
 
 
 Penalty Conditions (Level 6-Crime)
Type
Condition(s)
1-3
a) occasioning death;
b) involving the taking of hostages resulting in death of one or more hostages;
4-6
a) involving sexual offences and death of one or more victims;
b) involving torture or cruelty and death of one or more victims;
