| 26.1 | General Principles of the Court | |
| The general principles of the court are the essential principles by which all court matters shall be handled and dealt with before the court in relation to civil and criminal matters. | ||
| 26.2 | Presumption of innocence | |
| All persons are presumed to be innocent and no person may be convicted of an offense unless each of the primary facts of the offense are proved beyond a reasonable doubt. | ||
| The fact that he has been arrested, confined, or indicted for, or otherwise charged with, the offense gives rise to no inference of guilt at his trial. | ||
| 26.3 | Official Language | |
| The official language, is the language both spoken and written in all Courts and all court documents as well as the translation and presentation of all evidence. | ||
| The official language spoken and written in all Courts of Americas Union shall be the official language of the Americas Union. |
||
| Charges (prosecution acts, prosecution proposals, and private charges), appeals and other petition requests are directed to the court in the official language. |
||
| Everyone who does not speak or understand the Official language and its alphabet may direct the petition requests to the court in his or her language and alphabet. |
||
| An arrested foreign citizen has the right to direct his petition request in his native language to the court, and in other cases- under the condition of reciprocity. |
||
| Court summons, decisions and other writs are directed by the court in the official language. |
||
| To the citizens of Americas Union , the court summons which will be delivered to him or her will be written in the official language. |
||
| To the accused, the writs will be delivered in the official language and any langauge which he or she petiton be used in the procedure as their natural language. |
