Article 17 - Public Notice and Gazette

17.1
Notice (link)

A Notice is hereby recognized as an Official Instrument of the Society when complying with the prescribed form designated by its type.

When a Notice is valid, it shall carry the full force of the laws of the Society as an Official Instrument of the Society and a proper extension and record of those laws.

In general form, a Notice shall be the physical authentic original recorded and reproducible instrument of publication of an official requirement by obligation of Law of the Society that a party named in any legal process concerning the laws of the Society affecting their rights, obligations or duties to be made aware of this process.

 

17.2
Three Forms of Notice (link)

The Society recognizes only three forms of notice: Public, Actual and Constructive.

(i) Public Notice shall be any valid Notice given to the Members of the Society by any agency or legislative body in a rulemaking or lawmaking proceeding through some public means of pronouncement including (but not limited to) official gazette, newspapers, public web sites, radio and television; and

(ii) Actual Notice shall be any valid Notice given to one or more Members of the Society by direct means of conveyance including (but not limited to) email, letter and personal service; and

(iii) Constructive Notice shall be the promulgation of notice by public notice and/or actual notice in such a manner that another man/woman or entity or association or corporation is presumed to have knowledge of the matter even if no acknowledgment has been received.

Official Gazette (link)

The most authoritative and highest Official Gazette is the Ucadia Gazette, published by Divine Authority in accordance with the canons of Astrum Iuris Divini Canonum and the sacred Covenant Pactum De Singularis Caelum and is the Official Newspaper of Record for UCADIA and a modern, efficient way to disseminate and record official, regulatory and lawful information in print, online and electronic forms.

In Western-Roman Law, international law and the laws of the Society, the production of a copy of the Official Gazette of the Society, published under authority, containing a copy of the order, announcement or adjudication is evidence of the fact.

17.4
Publishing Official Public Notice in Ucadia Gazette (link)

An Official Public Notice shall be published in the appropriate Ucadia Gazette in accordance with the following criteria:

(i) That the completed form associated with the proposed Public Notice fully meets the requirements and prescribed form as defined by the Universal Standard Form criteria of the Society; and

(ii) That the type of form is active and available for selection from the Form Selection Category and then Sub Category; and

(iii) That the Member has the permission to seek the publication of the particular form and Public Notice; and

(iv) That the completed form and minimum required information has been properly conveyed to the Society to check and complete the publication; and

(v) That the form and information has been checked and approved.

If one or more of these criteria are not met, the Society reserves the right to reject the request of a Member for the permission to upload one or more forms and public notices.

17.5
Rejection of Requested Public Notices for Ucadia Gazette (link)

The Society reserves the right to decline or reject any proposed Public Notices requested to be published in the Ucadia Gazette which include errors, in particular the following most common forms of error being”

(i) The template used for a form is not the prescribed form an varies significantly from the correct form ; or

(ii) The name of the Estate, Trust, Person or Member is different to what is recorded against the account or previous published documents through the difference of case, additional words (of, clan, prefix etc) or less words (missing name etc); or

(iii) The number of the Trust, Estate or Member is different to the proper number recorded on the system; or

(iv) The register number for the day and time does not properly match the day/time selector, or the Roman day/time is different; or

(v) The use of a Latin signature at the end of a document does not match the proper maxim and style, or includes incorrect location information or year information.
